LAW41600 Law of Aviation Finance MSc

The objective of this module is to develop students’ understanding of the legal framework for the financing of civilian aircraft. The module will begin by considering the fundamentals of the law of finance including the law of contract, property, equity and trusts. It will then examine public international law aspects of civil aviation. The second half of the module will focus on specific issues pertaining the financing of aircraft including: sales of new and second hand aircraft; financing structures for pre-delivery payments; operational leases; finance leases and secured loans over aircraft; registration and priority of international interests under the Cape Town Convention; aircraft finance and the conflict of laws.

Learning Outcomes:

On successful completion of this module students will be able to:
1. identify and discuss the principal rules of the international legal framework governing civil aviation;
2. describe the principal features of operating and financing leases of aircraft;
3. make informed recommendations about the future development of international harmonisation in aviation finance;
4 describe and critically asses the operation of the Cape Town Convention on international Interests in Mobile Equipment and its associated Protocol on Matters Specific to Aircraft Equipment;
5. identify and critically assess the continuing challenges in evolving an international framework for the unique legal problems associated with the financing civil aviation.
