This module will cover the following: the justification for intellectual property protection, patentability of inventions, patent infringement, passing off; registration of trade marks; infringement of trade marks; protected works under copyright law; copyright infringement and defences.

Learning Outcomes:

On completion of this module students should be able to

• discuss the function of intellectual property law, and how the relevant rules of law promote those functions.
• apply the relevant principles of law in a practical context
• analyse the intellectual property laws currently applicable in Ireland and across Europe

Patent Law and Policy: The Patent system in Ireland and Europe, The Justification for Patents, The criteria for patentability, Infringement, Patents and Access to Medicine

Copyright Law and Policy: The Justification for Copyright, The criteria for copyright, Copyright and the Internet, Infringement, Overview of defences

Trademarks: Justification for trademarks, Passing off, Registration of Trademarks, Infringement of trademarks

Approaches to Teaching and Learning:
This module is taught over 10 weeks of lectures, plus two reading weeks. Lectures will be run as seminars, with students expected to prepare for class by completing readings and being ready to participate in discussions. Supporting material and handouts will be provided on Brightspace to allow students to learn from home, and to complement the lecture discussions.

Group feedback will be given in class throughout the semester, as students work on their assignments and class activities. This will include peer review activities in class, and tools to self assess their work. Individual feedback will be available during office hours. Group Feedback will be given when the assignments are submitted.
